I am told that the class action lawsuit against SurroGenesis, Michael Charles Financial, Tonya Collins and others will be filed today in Alameda Superior Court. The litigation attorneys had hoped to file it last week but, as is customary in these kind of complex civil cases, the Complaint needed some fine tuning. I hope to be able to post the Complaint on this blog once it has been filed.
I am also informed that there has been some progress in the U.S. Postal Inspector’s investigation. Their focus appears to be on the banking documents and it has continued even as the FBI investigation has remained stalled. If you are one of the victims, I continue to encourage you to contact your local law enforcement agency and report the embezzlement. At this time, the more pressure that can be brought to bear, the better, particularly as Tonya Collins seems emboldened by the lack of activity by law enforcement. We are advised that Collins continues enjoying her life in Texas while not burdened by any sense of remorse or responsibility. This includes having just acquired a new car and entering into a new relationship.
Finally, I would be remiss if I did not mention that there are a number of former SGUSA employees who have been assisting both law enforcement and the victims’ attorneys. While I understand the frustration and helplessness so many of the victims are feeling, the focus needs to be on Tonya Collins and the truly culpable perpetrators. We have learned of reported threats made against former employees and I would caution everyone to be very careful so as to not allow your understandable frustration and anger take over your better judgment. We need to keep law enforcement focused on those responsible and not give if these people any opportunity to victimize you all over again.
