Serious Allegations Of Misconduct Leveled Against Miracles Egg Donation and Surrogacy, Inc.

Yet another agency in our industry has been accused of impropriety involving the handling of trust funds. Miracles Egg Donation and Surrogacy, Inc., allegedly an international agency with offices in California, Australia and Europe, has failed to timely pay numerous surrogates and egg donors and has been accused of embezzling Intended Parents’ trust funds.

If you are a Surrogate, Egg Donor or Intended Parent you should immediately contact your attorney to discuss the status of your case and trust funds. I encourage all Miracle Intended Parents, Surrogates and Egg Donors to demand an accounting of their trust funds – including a copy of the current bank statement. Internal ledgers generated by an agency’s accounting software is practically useless as it in no way imparts any information on how much funds are actually on deposit in your account. Finally, you ought to demand that whatever trust funds you have remaining on account (assuming the funds have not been misappropriated), should be immediately transferred to an independent escrow or trust company.

    This woman, Allison Layton made life a living hell for my daughter, who gave birth to twins for a couple in Germany! I hope she gets jail time for the heartache she has brought on to both families!! She turned what should have been a very joyful experience into a nightmare! She made herself unavailable for calls and turned everything around on the families; removed contract items and failed to disclose that to the parties involved! To say she is evil is an understatement!

    • I am very sorry to hear what your daughter and her Intended Parents have gone through as well as the others who have been victimized by this agency. I hope the is investigated and everyone involved is able to recoup their escrow funds in full and move on with their journeys. I don’t understand why they would do this to people who have already been through so much and those who are so giving of themselves. It makes me sick! They know all too well that the majority of the people they are victimizing will not be able to realize their dreams of becoming parents without that money. Just another reason agencies should be regulated.

      I used to work there and know that Miracles does not alter the legal contracts. That is all done by the attorneys who draft the contracts. If she had a problem why did she not ask to have the contract changed to better suit her? That is what her legal counsel is there for. So why would she sign the contract?

  • This just makes me so very sad and angry to read things like this. Angry that an agency would behave in such manner that allegations of this kind would be levied against them in the first place. And so very sad to read about the pain this agency has caused this woman, her daughter and others. My thoughts are with them.

    I was an IP that dealt with these people and they wasted months of my time!!! It took me three months on a contracted no show egg donor? I don’t think she ever existed! These people were a nitemare! Stay away! It took me about a month to get my money back

    It’s about time that Allison Layton gets investigated; she has managed to evade the reality of her actions for many years now, but there may be a light at the end of this tunnel of madness. Her spending habit’s have spiraled out of control and a lavish life style living enabled by stolen monies from intended parents, donors, and surrogates, just may come to an end. Allison Layton has taken advantage for her own personal gain, and is a habitual liar, currently living in a million dollar property while her personal home is in foreclosure; this woman is in financial ruin and many innocent victims that she stole from will be paying for her wrong doings, definitely prison time is deserved……..I hope that justice will be served for those who have endured such malice.

      She has four children. 3 teenagers and one new baby. It is very sad that someone who is a mother is causing so much pain and heartache to other women with children and families. Her own family has been living “the good life”, while other women with good intentions are struggling because of her actions. Usually I would not want a mother taken from her children, but she has to realize the severity of what shes done and be brought to justice. Jail time is definately deserved for someone who destroys lives and relationships and profits from it.

        I can’t see how she ‘destroys’ lives. She is in the business of making babies…..
        I understand that not every pregnancy is going to be perfect, and that it can be disappointing when an embryo does not take. I tried with a different agency several times before switching to Miracles. I had a very bad experience with the first agency and an excellent experience with Allison. I was going to give up on parenthood before I met her.

          Some people have had ok experiences with her agency, but most of them who did had their babies a year or more ago. The surrogates, egg donors and IPs in the last year, and in particular the last 3 months are the ones having extreme difficulty with payments, money reimbursements, and even communication. Although you may have had a good experience, there are those of us who are still hurting and still going through this madness right now.

    I contacted Miracles and my attorney. Our attorney verified having the donor’s fee. We never paid Miracles anything other than their fee. The donor fee and attorney fee went directly to the attorney.

        My attorney paid the donor not Miracles. That is the way they have it set up. That is what my contract states. I did not think to question it as this was our second donor cycle and the other agency we used did the same thing.

            Of course not. She is hiding out at home, not answering emails, voicemails or texts because she doesnt have te money to pay anyone. But at least her husband will know what shes been up to now if he didnt before. “ME” are you an egg donor that has not been paid?

Our children are now almost 2 years old and I am thankful for the services Allison provided on a daily basis. Every time i look in my childrens’ eyes – I am grateful to God for the miracle that Allison helped make happen. My experience with her and the agency was perfect. So was the experience of everyone else involved with the agency – including doctors and surrogates. So, I’m not sure who is writing some of these horrible things, but it seems as though they need to be checked out before judgements are made. If this woman was a criminal, she would have charges against her and the DA would definitely take an interest in such a matter. There are no such charges and a disgruntled person should not be making such claims in such a public forum.
    I am forever grateful for what this woman has done, not only for me and my family, but for the scores of other people she has helped as well.

      I know that my self and many others donors/ surrogates are women who have great intentions and were brave in helping to give the gift of life to hopeful recipients struggling with infertility .This embezzlement scam has gone to far putting the lives of these women and their courageous deeds in jeopardy for the financial benefit of the company’s owner Allison Layton.

      I am truly astonished that there are people out there as I read some things online turning the other cheek acting like this problem does not exist because it did not affect them .When I as well as others must live with this injustice everyday. Just because some people received what they wanted out of the deal they act like Allison is this nice innocent lady who didn’t hurt anyone.

      What happened was Allison just wanted our donations and intended parents money to in the end be able to massively profit. She wasn’t ever going to actually give it to us donors/surrogates later on when the checks became larger .I feel now it was her plan to gain our trust with a couple smaller checks (that never came on time ,by the way) probably because she never had the funds completely at one time juggling compensation funds from one donor/ surrogate to another .We trusted having received smaller sums of money we would get the larger sums that we were contracted for. She as well as her staff were always super polite and full of excuses when things went wrong .She was so nice that I almost could not bare not believing her when I felt things were fishy .This was a business relationship I had as a donor with the company for about 3 years. .I really did believe she cared about my well being but that was all a lie they all could care less. Now what also has happened is (some not all) recipients are aware of the situation or do not care about the situation assuming their donor was for certain “paid” they are out there with our genetic DNA that we literally suffered to give and they are now trying to start families and living their lives. While the women who made it all possible were literally thrown to the curb and ignored with no compensation for anything as legally contracted. All I’m trying to say is someone out there has my eggs my DNA and I was never compensated or even treated with respect . So please no one ignore the situation if you have worked with Miracles in the past please look into the matter seriously..

      No one but the other donors /surrogates and their families understand the hard ship that Allison Layton has caused us .The feeling that not only did some one steal from you they stole a part of you. There were so many nights I could not sleep because of how deeply this has negatively affected my life. I started being a donor because I wanted to make a difference in the lives of others and in my own life as well . I trusted that the compensation for my efforts could in return help give me a brighter future and I could have the tuition money for school . Now there is not enough money for school like I intended to have ,I came down with health problems from all the harsh medication I was on from the cycles .My life is not were I expected it would be at this time . I have no way to make that kind of money back working a min. wage job to afford to continue school. I also am not trying to be like “oh poor me” but this is a small insight to just how she affected my life and the life’s of others .

      For a time everything was ok I did 4 successful cycles. The 3rd compensation check came 3 months late but they had an outlandish excuse for why that occurred. At that time I was already doing a 4th cycle I was previously contracted for .Then when the 4th completed in Jan. 2011 I received nothing .I called & I emailed relentlessly Allison and all her associates. But they would never answer my questions they just say they help me if they could .I called her personal cell phone everyday but got an inbox that was full every time filled with what I now believe were more upset donors/ surrogates wondering where there contracted compensation was as well. She also knew I have a hard time suing her being a young women with out advanced legal knowledge and no funds for a lawyer. I hope that everyone can get together and make sure this women gets what she deserves( jail time) we also should even involve the media or anyone that can help give the donors/surrogates a voice that Allison tried to silence.

    You are so Blessed to have had a great experience with Allison, but there are many of us out there that have been screwed by her!! She is in over head and No other girl should be put through what i went through and what these other girls went through. How dare you come and criticize these women for speaking up!! Everyone should know the truth! I am a donor and let me tell you!! She Screwed my bad! And I hope that this blog is read by the next girl that thinks about using this agency and runs!!! I don’t want anyone to go through what i went though. I’m Sure the ID parents have a different experience then the donors and im sure they told you your donor got paid!!     For those of you who have had good experinces with Miracles that is great for you, but there are those of us who have been negetively affected and deeply hurt by Miracles and Allison Layton. Most of the time, it has been the surrogates/egg donors who have had the most issues, because she tends to tell the IPs what they want to hear since they are the ones providing her with money. She has no concern for the women who give of their time and bodies to make other people parents. Most of these serious issues have come up in the last year and have gotten progressively worse over the last 3 months as it seems the money has completely dried up. Allison does a great job of keeping her egg donors/surrogates away from each other with no communication so they are alone and in the dark. Her own staff had no privy to financial matters either, she controlled it all. Money that was said to be in trust or escrow accounts for the parents never was, it was always right at her fingertips in her own personal company account. Also, she tells the IPs lies about their egg donors/surrogates to drive a wedge in the relationships so they no longer hear or believe what is going on.This is what she did to me. I was a surrogate for her company and NEVER was paid on time my entire pregnancy with the most unreasonable excuses why not. I am stilled owed a large amount of money months after giving birth with no end in site of me ever being paid, nor any possibilty it seems of the medical bills taken care of either, even though she has already taken all of my IPS money. I have never met someone so manipulative in my life. She was able to spin all kinds of stories for my IPs about why I wasnt being paid or bills taken care of. My IPs can no longer get in contact with her either, though she suppossedly has tens of thousands of dollars of their money. While surrogates and egg donors struggle with the effects of unpaid medical bills and not being paid or reimbursed our expenses, she lives in a million dollar home, has 3 high end cars, and has used the money entrusted to her to pay others for her own personal gain. I dont even think her own family is truly aware of what is going on. She no longer answers phone calls or emails and stays out of Miracles office and no longer has a staff. There are many victims, most of whom choose to be anonymous or come forward quietly to the attorneys for fear of retribution. I believe she will eventually be brought to justice and know that legal avenues are being pursued.

    Does anyone know if there will be an investigation with the clinic they ‘partner’ with? I know that Pacific Fertility Center clearly went against the current guidelines regarding egg donation in our case. Interested to know if they will be looked at, too?

    Basically my experience with this agency is that they are pushy, don’t pay anything on time, treat their surrogates like crap if you dare to question their motives/way of running things and do not do proper checks on IPs and possibly are breaking laws by providing false information for legal contracts.

    My journey ended up where the agency never completed a proper background check on IPs and we found out 11 weeks into the pregnancy that our IPs were NOT who they said they were and were much older than I was told by the agency. Alison would badmouth me to the IM and then badmouth the IM to me. She put me in the crappiest of hotels to save money and most likely pocketed the extra. She would constantly threaten me for being in breach (when something like having to switch days for appointments due to lack of childcare would come up) and then would be late on my compensation payments and paying bills in my name numerous times. The information they provided for our original contract later ended up being false information. They used fear, breach of contract and control as well as belittling and making you feel like you had no legal rights to get you to do as they wanted. I found out later they did the same with the IPs. I had to involve my amazing legal representation who went above and beyond to make our journey livable due to the agency, specifically Alison. They knew my IM’s true age (i believe) and sent me pictures of her looking at least 20 years younger, I felt they knew what they were doing and decided to simply match for cash. They also didn’t allow any communication between IPs and GCs until AFTER contracts were signed which was just shy of 2 weeks before transfer.

    I have a 20 page history (as well as all needed documention) of issues that happened during the matching and pregnancy should anyone of a legal/criminal nature be interested in needed further information to show that the agency is solely after income and not after the best interest of surrogacy or the children conceived from these messes of matches they put together. We started a lawsuit years ago, but realized the resources financially were not enough for us to see it through. I would like nothing more than to see this agency shut down and all criminal charges be brought and met. It is my opinion that this agency is breaking laws and ethics at every turn for sole financial gain.

    And i’m sure there will be those who want to point out my fault in my journey. You’re more than welcome to but if you search every single post where I share about my journey falling apart (which aren’t many as I was threatened by Miracles that i’d be sued for defamation) I have never denied that I should have done more and not matched so quickly. I should have listened to my gut and the red flags. I should have refused to sign contracts until I was given more ample time to get to know my IM and if the agency refused, I should have walked. I thought I could trust this agency as I had been friends with one of the employees for about a year. I thought I could trust this agency who had no negative things posted, filed or talked about them. I believe, while I could have done much more, this is another case of an agency taking advantage of IPs and surrogates solely for profit.

      I was only there for a few months and I helped work on your case and you were in breach of contract for numerous reasons. You would not tell the IM when you were going into labor. You decided to have a home birth when the contract did not allow for that and the attorneys involved, and the IM insisted the baby be born in a hospital. You did what every IP is terrified of in this industry, you took advantage in every situation and control of their baby having them walk on egg shells not knowing what you were going to do next. Miracles last I knew had more than 20 pages on you, and so did the IM, along with Miracles attorney and the IM attorney. Your IM called the office daily in tears with things you were threatening her with. Luckily she got what she set out for a healthy baby. They do not do background checks on the IP’s. They request psych evals, and copies of DL. Which is more than what the agency I now work for does. They only do full background on the surros. I have worked with 2 other agencies and they all have their issues with either non-compliant surros, donors, or IP’s. I feel that each agency can have their own faults and have learned not many surro cycles go without issues. There are clients that take advantage and there are surros that do the same. You are the last person who should even be commenting on anything involved in surrogacy after what you did to your IM.

        Although that may be true for the above case—I never breached my contract in any way and all the lawyers I have spoke to regarding my case agree, yet I still remain unpaid along with most of my medical bills that are going to collections and I have not had any contact with Allison or anyone from Miracles for months now.

    I am a surrogate with them and on my second journey presently. I have not experienced any issues with money or bills not being paid, then or now. My IP’s were and are amazing. I have a great relationship with my IP’s and Allison. I could not be more grateful for my surrogacy journey. The Dr’s, nurses, and attorneys have all been wonderful too.

    Pacific Fertility Center really needs to be looked at by the medical board and legal authorities. For some reason this medical center is always a victom and blames everyone else for their mistakes. I heard of a surrogate who has recently filed a complaint with the medical board, the surro was transferred a embyro after the medical director of the IVF Clinic got laboratory results of a abnormal HIV result. I’m not a medical doctor, but I think the embryo transfer should have never taken place and should have made everyone repeat FDA Screening test. Later the Intended Parents sued the agency for the clinic’s wrong doing, which sounded like a mal practive law suit….. I did refuse to work with PFC, and I’m very happy with my clinic…..

    My husband and I heard about Miracles through a friend who used them and did not have anything but good things to say. Our clinic also had worked with them and did not report anyone with any issues with the agency. They said their donors and surrogates were all compliant and the agency was easy to work with. We unfortunately were not able to move forward with them since the surrogate we chose did not pass her medical screening last month. Her uterus was not adequate (and she was a prior surro with them last year). I guess something to do with her prior pregnancy? Even though her ob/gyn said she could be a surrogate again, our RE disagreed and did not approve her. Our Dr advised that we need to select another surrogate. So back to the search we go.
    It is hard enough to learn you cannot have a baby of your own. Then to finally make the decision to go down this path is an entirely new emotional and financial journey in itself. We decided to cancel everything for now and requested our funds be returned. We have received our monies back from the agency for the donor and surrogate monies we previously paid. We only worked with the agency a short time and we have nothing negative to report.
    If we can find another suitable surrogate to help us we may still consider working with Miracles and will hope our donor of choice with them is still available when we are ready to move forward again. Our friend had a good experience and still remains friends with their surrogate. If they had issues with the agency I would think they would not have told us about them.
    However, we have learned not everyone will have a perfect experience in any aspect in life, just as we cannot have a child without assistance.
    Does anyone know how many clients they help annually? I am just curious the ratio of how many happy clients there are vs. the unhappy clients. When I go on all of these different sites to read reviews and do my research for the “right agency” to help us, I do not see a lot of good ever really posted? It is mostly bad. It is great to have these sites but if it is mostly bad why would these places still be in business? They would have to do some good if they are still open.
    Do people not report the good, only the bad? All of the agencies we had been researching, since there has been so many issues in this industry have 50/50 reviews. 50% good and 50% bad. The same goes for researching IVF doctors and even attorneys. Someone always has at least one “horror story” or negative thing to say. Which rightfully so, they should warn people of any issues just like people are doing on here. But when people have a good story it would be nice if they would share.
    Perfect example, this clinic you are blogging about on here. You have reported an issue without really knowing all details. It seems it is mostly hear- say, but how many clients has that clinic helped people to become parents, and how long have they been in business? If this was the actual case wouldn’t they be closed down? I am sure any reputable facility that has an issue, if that was even really the entire issue, would take all measures and precautions to make sure whatever the issue was large or small, that it never happened again. This case seems to be pointed at this incident, but how many others have had issues like this or similar that goes “unknown”. My biggest worry was always that they would mix up the sperm or eggs and us end up with someone else’s and visa a versa when we did our IVF. With all the research we have recently started doing, these stories of good and bad are out there and everyone seems to have an issue with someone like the clinic, a doctor, nurse, donor coordinator, agency, attorney, donor, or surrogate. So what is one to do, not move on because there is something negative said?
    We had also been thinking we could try and save money and go through surrogacy in India. That too has 50/50 reviews with both good and bad.
    Then thought we could try and do this independently without an agency and that sounds like an even bigger nightmare from what we have been reading. With stories of these women just taking more and more money from the parents knowing how vulnerable we are, or worse the baby. Don’t get me wrong what surrogates do for those of us who cannot have a child is amazing, but again there is the flip side and there are surrogates who also give this industry a bad name and are here for just the money. Again back to the 50/50. Hate to say it but its true.
    Even adoption has its nightmare stories with babies being bought and sold and birth mothers signing contracts with more than one family to get as much money as possible, to back out just before having the baby. Even changing their mind and taking the baby back. Some stories are just awful, and then there are the stories that are picture perfect.
    This entire industry definitely needs standards which would hopefully make it much easier for all of us. I think with any of this no matter the agency, doctor, donor, or surrogate we all need to proceed with caution and hopefully end up with a healthy baby, and that is the best we can do.

    Yes that is true, everyone has a different experience but when a company says that they are open for 8-5 Monday through Friday and the phone always goes to a voice mail and when you can’t get anyone to call you back or email you back, then you know there is a problem. After I signed all the contracts and I went through the procedure, all of a sudden no one is available and my check is lost or the accountant needs more information, but when i emailed the accountant back, it went straight to Allison Laytons automatic response. “Hello, I will be out of the office, but will be checking emails periodically. Thank you, Allison.” And Im supposed to believe that its not Allisons fault that I’m not getting paid. Scaaaammmm!!! i am still upset about this. Oh ya what about the time she called me three times and when i answered it she pretended that there was bad service?? That was funny. Then she said she was trying to get back to me promptly.I left a message with her assistant three weeks ago to call me back. Ya real prompt Allison. And I loved how when I emailed her saying I thought her company was a scam and she ignored my email and asked me if i want to donate to another couple. And this time shell make sure i get my traveling expensiveness covered. The last time I told her she didn’t include my expensiveness in the contract she ignored me and I just signed the contract anyways because I didn’t want to have to wait another cycle to do the retrieval. Yes big mistake on my part. Since I wasn’t getting paid i called around to all the local fertility attorneys and they all told me that i probably wasn’t going to get paid because they have all heard through the community that shes really not paying anyone. Now this is not normal I should not have spent 3 weeks trying to get paid. This company is BAD stay away.

      “ME” Im sorry your having such a hard time as a donor with Miracles as well. She is using the same tactics on us all. She did the same thing to me, calling me three times and pretending there was a bad connection, then she would call right back so it would go to voicemail and leave a message. Then when you call her back she doesnt answer. She would avoid voice communication, only would answer via text or email. In emails she would never answer questions, always side step them and ask you something else. I dont think her “assistant” ever existed, I believe it was just Allison trying to buy herself time. Although I was a surrogate who has already given birth, I am owed a significant amount of money and have tons of medical bills that are yet to be paid as well. According to the girls that worked for her before, they always told me that Allison was the ONLY one who handled the money end of things. She was given thousands of dollars from my IPS up front to pay for everything, yet they cant get ahold of her now either? I havent hard anything from Allison or the agency in over a month now and its longer than that since anyone was in Miracles offices to answer the phone. “IPS” any agency that neglects to call back the women who have already preformed their contracts and also the parents who entrusted their money to her, is dishonest and there is something deeply wrong going on. I think its safe to say at this point that all the negative about this particular company is true. There are good surrogate companies out there who have very little negative comments about them, I have a friend who has been a surrogate 3x and there are a few trusted ones in the industry. I wish I had done this much research before I signed up with Miracles. I am not sorry I did it, because I was able to give a wonderful gift to the couple I carried for and I love their family, but some things like being matched within the first week would have tipped me off if I had known more about it. It was my first experience as a surrogate so I didnt know. “ME” have you spoken to Andy?

        Allison Layton knows well how to play the game; if her mouth is open, you can guarantee it’s a lie, family issues……hello, it’s a complete lie and the sad thing is to use her children as an excuse, what mother does this; lets just say not a good one. Just as noted in the comments, Allison Layton is completely out of money, and will be running to the rock from which she crawled out from under very soon.

            After I contacted the FBI, i sent her an email. She all of a sudden wasnt dealing with family issues and her email worked again. She put the money in my account that day, and asked my to notify the FBI that i recieved the money. Which I did.

    Dear Ella,

    Why is your company just working with one law firm and one IVF Center in California! This IVF Center that you praise has so many birth with birth defects. I know three surrogates who have given birth to twins or singleton pregnancy’s with birth defects (clients claim Genetic Testing was done). This clinic needs to be looked at or clients need to go elsewhere. Putting all your eggs in these two companys is scary!

      well, thank you for your message, I really appreciate your time in doing so. We have worked with this law group for many many years in fact, the owner, Tom Pinkerton, was able to get the very first pre-birth order for a same sex couple not only in the USA all those years ago, but he was able to get it for the first European couple in 1998 too. We have a lot of respect for this man and his firm.

      In respects to the IVF clinic, we are not aware of any abnormalities that anyone has had issues with over the past few years from babies born through CFP. Certainly we have not had couples that have had such a problem at all. In fact, it is one of Dr Ringlers stipulations that all egg donors must have genetic testing done and he gets the reports, copies to IPs, for each egg donor.

      I think at the end of the day, the clinic performs due diligence throughout the process as far as we are concerned. If the surrogates you refer to were with a particular agency and this was not carried out or maybe false / missleading information was provided to the clinic by them, then of course there may well be an issue.

      You must also be aware that the clinic does not perform the genetic counselling themselves and have to rely on the professionalism of the service providers involved in that side of things. In my opinion, as good as it might be lol, i highly recommend them.

      I personally can only say extremely nice things about the IVF clinic CFP, they are very professional and have always gone out of their way to look after each and everyone of our clients and we have personally been working with them since 1998.

    Ella, these cases were handled by Dr. Marrs and Dr. Vargyas, their cases resulted with Birth Defects. Do you really think an IVF Center is going to share this information with the public? What planet do you live on? Regardless of how much genetic testing you do, you still have a chance of having a baby with birth defects. I personally know the IP’s (the IP is a medical physician who used CFP services). The IP’s wanted to block the surrogates compensation and blaming the surrogate for the birth defects. All genetic testing was done, something Failed! Like I said “I’m just sharing some information” and this is way I said “its not a good idea to put all your eggs into two companies”…..

    you can hardly blame the clinic if the baby was born with birth defects and all due diligence was carried out. There for the grace of God do we all go!

    The IPs cannot blame the surrogate, every agency owner, maybe not the one in question here on this blog, legal contract etc states that there could be a chance of birth issues and the IPs and surrogate will make decisions about that if there was a need too.

    If we were working with twenty clinics, the chances would still be there, or more so as we do not know them form Adam, and as i have said previously, some of our staff have worked with Dr Ringlers team for over 13 years now and NEVER had an issue. When and if we ever did, we would of course review, but right now, there really is no better service than the one we get from these two companies.

    With regards to the genetic testing, this is actually done by a qualified professional, BUT and it really is a BIG but, nothing is 100% we can test for this and that with the egg donor or surrogate if she is a TS, but we do not test extended family members and certainly for egg donors who were adopted themselves, they will not have an any history of their biological parents etc to work through the possibilities of possible issues that might come up.

    We were told of a case recently whereby an egg donor, who was adopted, didnt know that she had the Albino gene, she had been a donor 2 times previously, and nothing shown up visually of any albinism, on the third and last cycle for a new couple, the IPs had twins born, one was an Albino. the agency involved in that contacted the previous IPs that she had donated too and informed them of what had happened and they had their children born through the donors eggs test. The three children were all carriers of the gene that can cause/pass on to their progeny. She had gone through genetic counselling but it had never been talked about because she didnt have any physical display of the condition and no known history of it in the family she was brought up in.

    I guess what im saying to you is that nothing is certain in this life!

    As far as what planet do i live on, sometimes i do actually wonder that myself! lol

    BBB Business Consumer Complaint
    Complaint: 09/06/2011: I am an egg donor and have had a number of problems with this company and the owner A. Layton. I have never been paid on time the 3 times I have worked with them even after signing contracts stating that I would be paid within 7 days. each time I have been ignored for weeks/months and when I finally receive an answer I’m told my check must have been Lost in the mail. From the start of the cycle I had issues because no lawyer wanted to work with Miracles due to the fact that their clients were not being paid and at that point I wanted to cancel the cycle but A. Layton and the Dr involved sent a number of emails and phone calls saying, It would be a major loss/disappointment to the intended parents if I were to cancel. I refused to continue without receiving a postdated check in advance to avoid non-payment but to my dismay even after going through the trouble to protect myself the check bounced after depositing it and I incurred a Bounced check fee to my account. Ms. Layton no longer answers my phone calls/emails and the doctor that performed the procedure even tried a number of times to step in and contact her on my behalf but received no response either. My payment was supposed to be in a trust/escrow account but apparently never was. Working with this company has been the most stressful business experience I have ever had and by next week I will be retaining a lawyer if this isn’t resolved.

    Business response: This egg donor will be compensated and shall be receiving the money she is requesting and rightfully owed. We have responded to every email as well as the doctors. She has emailed after business hours on weekends and or Holidays. We have gotten back to her upon the return of open business hours. We have not received any calls from her nor has she left any messages with any issue. Therefore, without leaving a message we are not aware of her call to return her call. The egg donor chose to go forward without any legal representation and signed the legal contract but also signed a legal waiver.

    Consumer rebuttal: Ms. Layton/Jarvie’s response is full of half truths & elusive promises. She began with “This egg donor WILL BE compensated…” But no reference was made to when. Will be compensated tomorrow? Next year? This canned response does not reference the contract we each signed which said she had a max of 7 days to remit payment. The last cycle I waited over 3 months to be paid & this time she is almost a month late already with no payment in sight. Actually she is more than late, she sent me a bad check weeks ago knowing full well there was no money in her account. The check was & always is sent from her personal business account, not the trust fund/escrow mentioned in the contract. She should not have had access to the money in the first place to be able to misappropriate/”Misplace” it. Ms Layton/Jarvie makes reference to emailing “Outside of business hours”. While I did email her after business hours due to attending class during the day how can she even attempt to use this as an excuse almost a month later? It hasnt been outside of business hours the entire stretch of her non-payment and it wasnt outside of business hours during the entire 3 months she was late with my last payment.

      Complaint: 09/15/2011: I was a gestational surrogate in the last year for a couple in Australia arranged by Miracles. I believe along with their non-compliance of the Family Code 7961 in CA, they are embezzling & misappropriating the parents trust funds that are meant for the Surrogate/Egg Donor & the payment of Medical Bills. My legal contract was never followed my entire pregnancy with payments since August 2010. I gave birth to healthy boys on 5/3/2011. I should have been paid my final payments within 1 week of birth. After contacting my contract attorney, I was paid my back payment from APRIL in JUNE and haven’t been paid any of my contractual amounts since. I am legally owed $9268.73 and have approximately $5000 of medical bills that have yet to be paid as well. Part of the funds owed to me are reimbursements that I have already paid up front. The parents of the babies I carried transferred over $100,000 to the agency to cover my surrogate expenses and medical bills.

    No I still havent been paid. Ms. Layton was in contact with me via email for one week but kept giving me vague statements and claims she is unable to pay me directly. Ive left messages on the Miracles machine with no return call. Ive asked her when exactly im going to be paid (if ever) and still havent gotten any answers and she no longer is responding to my emails anymore again. Im currently working with attornies, litigators, and the FBI but the process is slow.
    To FYI- There is no reason for you to not be able to send emails outside of buisness hours. Emails can be picked up by herself upon open of buisness hours the next day. Thats ridiculous. You are dealing with the same problems as us all. Allison is just trying to buy herself time with excuses and a smoke and mirrors show. I hope everyday to hear that she will be charged for the numerous accounts and women she has mishandled, because payment directly from Layton seems unlikely after all this time I have already been waiting.

    We were able to get a partial refund of $2500 after calling both the Glendora Police Department AND the FBI. We have still lost more than $10,000 in dealing with Allison Layton.

    You are correct. She does live in a million dollar home that she recently purchased and her husband’s name is Kevin. It has been a year since we gave her our life savings and it took most of the year to get some of our money back. I wanted to throw myself in front of an AmTrak train after dealing with this woman. She is pure evil. She set us back a year in becoming parents. We are finally recovering enough emotionally to arrange a surrogacy in India.

    I also wanted to mention that the $65,000 deposit we gave her never got deposited into the Allison McCluskey Escrow Agency account as stipulated in our contracted. It stayed in an account that was controlled by Allison Layton personally. That is why it took almost a year to get back $55,000 of the $65,000 we deposited.

    PLEASE call or email Lt. Tim Staab of the Glendora Police Department. At the time we contacted him (about a year ago) he couldn’t do much because we were the first complaint. We are forever grateful to him for helping us retrieve $2500 of our money.

    Dear Still Not a Mom, who was your attorney? It’s seem like many law firms are not opening escrow accounts as stated in contracts which they over see…. Who do we trust, you can’t even trust that so called IVF Center, since many clinics are doing unnecessary procedures and making the IVF treatments more expensive. You should probably file a law suit against the law firm who represented you, since they did not do anything to protect you….

    I am happy to hear I am not alone!! I am so thankful that someone created a blog like this. I hope we can all take this company down and all eventually get paid! Here is my story if anyone is interested:
    March 30th 2011 I signed up with Miracles Egg Donation to become an egg donor. That following day March 31st 2011, I received a phone call from the company telling me I had already been picked by a couple!! I thought that was insanely fast but I decided it must have been meant to be and I was excited to start the journey that would result in giving someone a baby. At first I was dealing with a lady named Debbie who seemed to be very nice and very anxious to get the ball rolling. Shortly after that…mid April I was starting the process of tests, phone interviews, etc…. where I was then dealing with another lady named Amy D’Amico. She also seemed very sweet in the beginning…. As things went along and I got closer to my egg retrieval date, I rarely heard from Amy anymore. They all seemed to be very out of touch with me! My concern at that point was, as it states in my contract, that I would receive $500 upfront when I started my injections. I started my injections on June 13th 2011…so after numerous phone calls and emails wondering where my money was, I FINALLY received a check on July 7th 2011 for the total amount of $500. (Almost an entire month later!!!!) That’s when I realized things started to get a little suspicious…
    On July 5th 2011, I had my egg donor procedure. On July 6th I received a phone call from my nurse telling me that my last injection filled with the hcg hormone, was not found in my blood stream. It blows my mind that doctors would not give me one last final blood test before a major procedure to make sure the hormone was in my system. Anyways, point being, they supposedly were not able to retrieve any eggs. My next phone call that same day was to Allison Layton at Miracles. (because yet again I was pushed off to deal with another girl.. I never knew who to contact) ….after several phone tags we finally spoke and I broke the news to her. She then spoke with my IP’s (intended parents) and they had asked if I would redo the whole process for them. Without any hesitation I said “YES”…
    I then started to go through an emotional roller coaster. I couldn’t believe everything I went through.. I put my body through hell, I missed several hours of work, and so on… After all this, I felt it had been a complete waste of time. I was an emotional wreck. I got back in touch with Allison a couple days later to ask her about compensation. She straight up told me “let me see what I can do to get you some money for everything you went through” …well, several days passed and I never heard back from her.
    I could not start my second cycle until I got my period. So, my doctor put me on a mediation that would induce it. I put out of pocket my own money for the medication in which I was told would be compensated for. Still to the day, I haven’t seen a dime. At this point October was approaching and i was getting ready to officially start my second cycle. I called Allison at Miracles to let her know.. But when I called.. I got a disconnected dial tone!! I couldn’t even believe what I was hearing. My doctor tried calling as well and she got the same disconnected dial tone. I went online and did some research and realized that they had a different number posted on the website. I left them a message, and again.. No return phone call. I then sent Allison an email explaining my disappointment in the company and asked her why they changed there phone number and wouldn’t let there clients know!!!! She actually emailed me back and said “we sent an email out to all our clients letting them know” …I didn’t believe her for one second. I knew she must have been hiding something. I had also asked her about the compensation she was going to “look in to” for me for going through the first cycle. She called me several days later and explained in her “sweet bubbly voice” that I could not receive any money since they were not able to get any eggs the first time around!??? She said that because there was no HCG found in my blood that it was breach of contract.
    Anyways, this now brings us to October 10th 2011 when I started my second cycle of injections. Within the time I started this cycle of injections to the time of my procedure I still never heard any word from Allison. My doctor called her and left her several messages as well as emailed to let her know when my procedure date was. Still, no response!! Allison had promised to send out a RN to give me the last HCG injection so there wouldn’t be a screw up this time around. Well due to the lack of communication, that was never set up. My nurse was fed up at this point and hated to see what was happening to me so she had offered to meet up with me at the time I needed to receive that injection. So again, another promise broken and another thing I had to handle on my own without the support of the egg donation company. So on October 20th 2011 my nurse met me at my sisters house at exactly 11:00pm to inject me with the HCG.
    Two days later, on October 22nd 2011 I officially had my 2nd egg donor procedure. They got 13eggs and everything was a success… Except for one thing… Still no word from Allison. I knew I had to take further action so I called the attorney that was representing me through this process. She wasn’t surprised at all to hear about Allison and her lack of communication. I told her that my nurse heard through the grape vine that my IP’s had put my money in a trust fund/escrow account. My attorney had no clue about it but gave me the contact info for the attorney who was representing my IP’s. On October 30th 2011 I sent him an email explaining that I have not been paid my remaining balance of $4,500. But, still to this day no word from him. On November 1st 2011, I sent an email as well as called my nurse… Crying and begging for help! I didn’t know who else to turn to for answers. But, still to this day, no word from her either. I then turned back to my attorney and sent out another email that I was getting nowhere. She called me back right away but still didn’t have much info for me other then hearing rumors that Miracles offices were vacant and that several other girls had not been payed either. You could only imagine the pit in my stomach and the disgust I had for Allison. This same day, November 1st 2011, I decided to give it one last shot and email Allison. I knew calling her would be pointless because every time I tried, it just went straight to voicemail. Anyways, I wrote her an email and expressed my anger. I asked her where the heck my money was because as it says in my contract, I am suppose to be paid within 5 business days of my procedure. Well it had been 6 business days at this point.
    On November 2nd 2011 I actually received an email back from Allison. I was in shock!!! Well, the email stated that she was “sorry to hear that I was unhappy with her company, and best of luck to me” BUT she DID NOT say a SINGLE WORD about my money!! I wrote her back right away telling her to stop beating around the bush and to pay me my money that was owed to me! In the mean time… I decided to google and do some major research on this company. Thats when I came across this blog. I was sick to my stomach that one person was capable of such a cruel act. I felt so used!
    I then wrote Allison another email telling her I was fully aware of the blogs out there and that if I didn’t hear back from her, I would take legal action. Well surprise surprise, she got scared, and wrote me back. Asked me what my correct address was so she could send my payment. But I don’t believe for one second that she is going to send it. I told her to send me an email to confirm she had sent it. Today is now November 4th 2011 and I still have no payment, no email, 13 less eggs, and a massive headache over the emotional stress this has caused me.
    For me, this has now gone way beyond just Allison cutting me a $4,500 check. (which should really be $9,500 for doing it twice)
    The way she treated me, the lack of communication, the lies… It just breaks my heart. I gave away a part of me and she just ruined what could have been an amazing experience. Giving someone eggs to create a baby is no joke, we weren’t dealing with baseball trading cards here.. This is major stuff. No one who hasn’t dealt with Allison will ever understand how I’m sure we are all feeling at this exact moment but all I can say is I am not okay with any of this.

    Why aren’t you giving the attorney name/s who supposely were hired to protect you? Who is this IVF Clinic you talk about? Why are egg donors and surrogates leaving out names in their blog posts! We need to start giving names of these so called professional and lets start making them liable too. Keeping crucial information from your post/s “is useless” and what’s the point of your post if your not going to name the professionals who are there to protect you….

      I did not leave any “useless” information out!! My issue here is with Allison Layton, not my IVF Clinic or my Lawyer. Everyone did there part except for Allison, so as far as everyone else is concerned, I do not need to mention the other two names. My experience with my nurse was wonderful and she even went out of her way to give me my hcg shot at my sisters house. As far as my Attorney, she was only a contract Attorney and does not represent me after my egg donor procedure. She did steer me in the direction of the lawyer who represented my IP’s. So again, no need to mention there names!!!!!

    Donorvictim, you might want to contact the authorities in Idaho. Rumor has it that’s where Allison Layton is running to. My guess is she will still try to operate her business and dupe people, until she is forced to shut it down. The FBI is your best hope at this point. Or maybe some news station. They might be interested in investigating Miracles Egg Donation shenanigans.

    The rumors appear to be correct that Allison, her husband and two of her four children are packing up and leaving their “rented home” (which has foreclosed a few months ago) and silently fleeing to the state of Idaho. There has been a large UHaul truck at their residence all weekend. At this point it would be best for all victims of Allison’s terrible doings to seek assistance by the FBI and local authorities. One wonders why she would go to the state of Idaho since apparently it is considered a “safe haven” for state wrongdoings but she still can’t hide from the FBI. I am truly sorry for all of you that have experienced such hurt and sorrow with Allison Layton and Miracles as this process toward having a family should be a warm, positive and happy experience.

    This thread is apparently someone that has a personal not professional issue with Allison. Someone that is doing business with her would not claim to know about her kids, types of cars she drives or about a Uhaul van or someone taking a leave from the office for stress. This is obviously a person or ex worker that is upset and trying to slander her name. Shame on you for doing this!!
    The postings are so obvious that whomever this is has inside knowledge of some issues, and some that I might add are incorrect only what one is assuming. I know some of her ex employees and can only guess that these threads are from her. It is sad that someone has to try and slander an individual to make themselves feel good about one self.

    ME—she did not screw over her employees…she was more than fair with them, I know that she had to let a couple go because they would not work. What a concept working for money. The only mistake she made with her employees is that she hired friends…which in my opinion is not a good mix since it is much more difficult to have that talk with them when they are not working up to the standards in which they should. I am having difficulty with this and hired a friend when she was in need and has been a good employee for 3 years but all of a sudden has decided she is tired of working and would rather now do minimal work and I have to go through the steps to get rid of her. Allison did make a mistake..hired friends in need of jobs..lesson learned do not mix friendship and business.
    Again, my statement stands that these threads are from a couple of individuals that do not like Allison and want to slander her name..and one that I find highly suspicious is that someone contacted the Glendora PD and then they got money back. The Glendora PD would not have jurisdiction in this type of matter to officially make her give money back. Many holes in these stories and things that do not make sense and for someone to claim to be involved with her in a business manner would not know about some of the personal items such as a moving van and etc. This is obviously someone that thinks they know the entire story. I have to laugh at the pathetic individuals that think they know everything and again are slandering her name!!! Miracles doors are not closed as someone has indicated.

    Amazing your a joke. Getting fired because your actually trying to do your job correctly and pay people on time is not exactly a good reason. Yes she did make many mistakes. The biggest one was taking money that belongs to someone else. She ruined her own name. Amazing Allison is a crimal. There is not point in defending her and trying to point the finger at someone else. When every one of these girls went thriving exactly the same thing I did, I find it very hard to believe its all a lie. Your the only fake on the forum.

    To GT I do not have any business dealing with Allison so in your words I can not get screwed over. I just know the inside facts and not because I am a client or former employee and you people only speak half of the truth and I find it funny and pathetic at the same time.

      Your point is not proven except in the anonymous, deluded bubble you have created for yourself. Miracles has defrauded dozens of Intended Parents, Surrogates and Egg Donors. These are not baseless allegations nor spurious claims brought by disgruntled former employees.

      How do I know? Because I have represented a number of these victims – some of whom have had their life savings stolen and have lost all hope of having a family because of the heinous activities of Miracles. I continue to assist dozens of others who are desperately trying to recover monies owed to them. At the moment, I cannot discern if you are simply misguided or pursuing an agenda. Regardless, you are only exacerbating the situation by mindlessly coming to the defense of Layton and I will not tolerate any more of your puerile name calling and feeble attempts to defend Miracles. Be respectful or be banned.

      As for your inane claim that she is being slandered by “pathetic individuals”, Ms. Layton knows where to find me if she wants to file a defamation claim. After 7 months of pursuing her on behalf of of these victims, she has chosen not to sue me for defamation. The reason is simple and that is because she is, in my opinion, a liar and a thief.

      I am baffled that you have no compassion for me or any of the other girls that have shared there story. Not one of these girls is here to slander anyone’s name, rather we are expressing our frustrations and want to fight for what we deserve. We were promised things by Allison that were never met. So unless you put your body through hell, missed numerous hours of work, had to deal with a lack of communication from miracles, and so on…. then, I guess you will never understand. But please, don’t make me or any of these other girls feel worse then we already do. We are here to help each other out. Its called paying it forward… maybe you should try it!

    I had my eggs removed with Miracles at the end of October and got my check when I flew back home. I read about this while I was in the middle of my doctor appointments and got worried, but I did not have a problem. If there was a problem I do not know about it since I have not had my eggs removed before. I worked with Allison, another lady, and the nurse at the doctors office the most. Everyone was very helpful. I only had some trouble changing my work schedule around the appointments. But I got my check within a few days or maybe it was a week after I got home. I don’t know if it worked if the lady got pregnant though?

      I know that my self and many others donors/ surrogates are women who have great intentions and were brave in helping to give the gift of life to hopeful recipients struggling with infertility .This embezzlement scam has gone to far putting the lives of these women and their courageous deeds in jeopardy for the financial benefit of the company’s owner Allison Layton.

      I am truly astonished that there are people out there as I read some things online turning the other cheek acting like this problem does not exist because it did not affect them .When I as well as others must live with this injustice everyday. Just because some people received what they wanted out of the deal they act like Allison is this nice innocent lady who didn’t hurt anyone.

      What happened was Allison just wanted our donations and intended parents money to in the end be able to massively profit. She wasn’t ever going to actually give it to us donors/surrogates later on when the checks became larger .I feel now it was her plan to gain our trust with a couple smaller checks (that never came on time ,by the way) probably because she never had the funds completely at one time juggling compensation funds from one donor/ surrogate to another .We trusted having received smaller sums of money we would get the larger sums that we were contracted for. She as well as her staff were always super polite and full of excuses when things went wrong .She was so nice that I almost could not bare not believing her when I felt things were fishy .This was a business relationship I had as a donor with the company for about 3 years. .I really did believe she cared about my well being but that was all a lie they all could care less. Now what also has happened is (some not all) recipients are aware of the situation or do not care about the situation assuming their donor was for certain “paid” they are out there with our genetic DNA that we literally suffered to give and they are now trying to start families and living their lives. While the women who made it all possible were literally thrown to the curb and ignored with no compensation for anything as legally contracted. All I’m trying to say is someone out there has my eggs my DNA and I was never compensated or even treated with respect . So please no one ignore the situation if you have worked with Miracles in the past please look into the matter seriously..

      No one but the other donors /surrogates and their families understand the hard ship that Allison Layton has caused us .The feeling that not only did some one steal from you they stole a part of you. There were so many nights I could not sleep because of how deeply this has negatively affected my life. I started being a donor because I wanted to make a difference in the lives of others and in my own life as well . I trusted that the compensation for my efforts could in return help give me a brighter future and I could have the tuition money for school . Now there is not enough money for school like I intended to have ,I came down with health problems from all the harsh medication I was on from the cycles .My life is not were I expected it would be at this time . I have no way to make that kind of money back working a min. wage job to afford to continue school. I also am not trying to be like “oh poor me” but this is a small insight to just how she affected my life and the life’s of others .

      For a time everything was ok I did 4 successful cycles. The 3rd compensation check came 3 months late but they had an outlandish excuse for why that occurred. At that time I was already doing a 4th cycle I was previously contracted for .Then when the 4th completed in Jan. 2011 I received nothing .I called & I emailed relentlessly Allison and all her associates. But they would never answer my questions they just say they help me if they could .I called her personal cell phone everyday but got an inbox that was full every time filled with what I now believe were more upset donors/ surrogates wondering where there contracted compensation was as well. She also knew I have a hard time suing her being a young women with out advanced legal knowledge and no funds for a lawyer. I hope that everyone can get together and make sure this women gets what she deserves( jail time) we also should even involve the media or anyone that can help give the donors/surrogates a voice that Allison tried to silence.

    Waggy, so you read about this while you were about to go thru the procedure of donating your eggs and in the middle of your doctors appointment, you decide to research the company……wouldn’t you do this prior? Lucky you, to get paid while all the others on this blog have not been or if any in an untimely matter in which it took the Glendora Police Department and FBI to recover any funds. Good try Allison Layton.

    We got $2500 back after calling the Glendora Police department who called Allison Layton. That is a fact that I can substantiate with emails and a photocopy of her check.

    The person who is trying to discount that fact needs her (blonde) head examined. Oh wait. I heard she was dyeing her hair so people wouldn’t recognize her…

    We recently completed our cycle with our donor and this agency. Not only did we have a great experience with the agency but our donor did great too! We are very pleased with the over all cycle from beginning to end. We are recently pregnant and with much luck my pregnancy will go smoothly and we will be having our first baby around the Holidays. I would use them again. Maybe there were some issues going on before but what we experienced was night and day from what we have read about here.
