California’s New Surrogacy Laws Are Now In Effect

Just a reminder that California Assembly Bill 1217 is now the operative law in California. AB 1217 is codified in California Family Code §7960, et seq. and became effective January 1st of this year. Among the important changes that will have an immediate impact moving forward is the requirement that all parties to a surrogate contract be represented by independent counsel and all surrogacy arrangements must be signed and notarized before any medical procedures commence. More information on the new code sections can be found here. Also, to get a better sense of the ground-breaking nature of this law, please read this.
